CONDITIONS OF PARTICIPATION
GENERAL TERMS AND CONDITIONS – 50€ Voucher

1. Registration/Participation An
e-mail address must be provided to take part in the draw. The participant is
responsible for changes to this data, in particular the e-mail address.

2. Eligible participants. All
persons who have correctly filled out all the required data, registered for the
competition and answered the competition question correctly (if there is one) are eligible to
participate. Employees, authorized representatives, legal successors and agents
are excluded from this.

3. Other Conditions of Participation.
A participation is only possible online. By participating in the competition,
the participant agrees to the rules of the competition and general Terms.
Participation is possible within the times specified in the competition or by a
specific date.

4. Determination of winners &
participation deadline from all participants who have registered for the
competition by e-mail, the winner will be drawn at the end of the specified
competition deadline of August 1st, 2022. The winners will then be notified by
email.

5. Prize. The prize in this competition
consists of a €50 voucher for a total of 4 people. The prize cannot be passed
on. In addition, no cash payment is possible.

6. Notification of Winners. Winners
will be notified by email.

7. Applicable law. The competition is
exclusively subject to Austrian law.

8. Transfer of Prizes. Prizes will be
sent via email.

9. Termination options. Wisteria
Clothing reserves the right to cancel or end the competition at any time
without prior notice. This applies if the competition cannot run as planned for
any reason, such as errors in the software and/or hardware and/or for other
technical and/or legal reasons that affect the administration, security,
integrity and/or regular and proper implementation affect the competition. In
such cases, Wisteria Clothing also has the right to modify the Sweepstakes at
its discretion.

10. Data protection. The personal
data we collect and process is primarily used for the purpose of processing the
competitions and, with the consent of the participant, for sending a
newsletter. In doing so, we observe all applicable data protection laws that
apply to Austria.

11. Legal recourse and liability.
Legal recourse is excluded. There is no enforceable claim to the payment of
winnings. Wisteria Clothing  is not
liable for the loss, lateness, delay, alteration, manipulation and/or
misdirection of e-mails and/or data during data entry, collection, transmission
and/or storage, which are caused by third-party data networks, in particular
the Internet or the WWW, in third-party telephone lines and/or other hardware
and/or software of the participants and/or third parties; this applies in
particular to incorrect, missing, interrupted, deleted or defective data.
Wisteria Clothing is also not liable for incorrect information that is caused
by participants and/or third parties, their hardware and/or software and that
is used for or in connection with the competition. No liability is assumed if
e-mails or data input do not meet the requirements set out there and are
consequently not accepted and/or accepted by the system. Furthermore, Wisteria
Clothing is not liable for theft or destruction of the systems and/or storage
media storing the data or for unauthorized changes and/or manipulation of the
data in the systems and/or on the storage media by the participants or third
parties. Otherwise, Wisteria Clothing is only liable for gross negligence or
intentional actions by its legal representatives, employees or vicarious agents.
Furthermore, Wisteria Clothing is not liable for any damage suffered by the
winner or relatives of the winner in connection with the prize. The above
exclusion of liability does not apply if liability is mandatory, e.g., in cases
of intent, gross negligence, injury to life, limb or health or breach of
essential contractual obligations. However, the claim for damages for the
violation of essential contractual obligations is limited to the 3
contract-typical, foreseeable damage, unless liability is assumed for intent or
gross negligence or for injury to life, limb or health. A change in the burden
of proof to the detriment of the participant is not associated with the above
regulations.

12. Severability clause. If a
provision of the conditions of participation is or becomes invalid, the
validity of the remaining provisions remains unaffected. In such a case,
organizers and participants are obliged to cooperate in the creation of
provisions that achieve a result that comes as close as possible to the
economic result of the ineffective provision.
